Last November, Elon Musk revealed intentions to establish an AI-driven video game division under the xAI banner, aiming to “revolutionize gaming.” Ex Populus, the driving force behind the Xai gaming blockchain, now asserts that this announcement led to “considerable real-world confusion” online. They claim that Musk’s xAI gaming venture has caused direct overlap with their own established Xai brand.
Attorneys representing Ex Populus claim that numerous news outlets and commentators mistakenly used the Xai blockchain’s logo when reporting on Musk’s announcement. They further argue that a significant number of internet users wrongly assumed that the two separate ventures were related. Even Grok, the AI chatbot developed by Musk, added to the confusion by incorrectly informing users that both entities were under the control of Musk’s companies, according to the legal representatives.
In a formal complaint submitted on Thursday, Ex Populus has asked the Northern California District Court to issue an order preventing Musk’s AI company from using any words or symbols that could potentially cause confusion with Xai’s registered trademark, particularly in the context of blockchain and video games.
The company is also pursuing punitive damages and demanding all profits generated by Musk’s organizations as a result of the alleged infringement.
Throughout their legal argument, Ex Populus’ lawyers have consistently asserted that Musk’s company has not only continuously violated their copyright since last year but that the widespread recognition and controversies linked to Musk have significantly amplified the damage caused by the supposed infringement to their brand.

“Musk and the xAI company regularly attract significant negative media coverage, which is now being associated with the XAI trademark belonging to the plaintiff,” stated the legal representatives.
The lawyers specifically highlighted a controversy from last month when Musk’s Grok AI bot briefly referred to itself as “MechaHitler” and published antisemitic, racist, and sexually charged statements across the X platform.
“The plaintiff’s loss of control over its reputation and goodwill constitutes irreparable harm, justifying an injunction to stop the defendants’ usage of the infringing xAI trademarks,” Ex Populus’s legal team argued. “However, being connected to Nazism, hate speech, and violence intensifies the harm dramatically.”
Ex Populus revealed in a public statement that attorneys representing Elon Musk had recently contacted them regarding concerns related to trademarks. The company feels that they now have no other option than to proactively fight back, “or risk losing [the trademark] entirely.”
“This legal action is not simply about Ex Populus or Xai,” the company noted. “It signifies a larger principle: the ability of smaller companies to innovate without facing the risk of their identities being overshadowed by tech giants.”
As of this writing, Musk’s xAI has not released any official statement following the Decrypt request for comments.
