xAI, the venture spearheaded by Elon Musk, is leveling accusations of trade secret theft against OpenAI, alleging they poached employees for this purpose.
The legal action claims that OpenAI recruiters aggressively pursued xAI engineers with offers of substantial compensation packages and perks.
The suit further contends that following these recruitment efforts, certain xAI personnel copied confidential data, including source code, instructional resources, and data center architectural plans, to personal storage devices or cloud accounts.

Specifically, the case highlights Xuechen Li, an early engineer at xAI. According to court documents, Li transferred xAI’s complete codebase to his personal cloud storage in July of 2025. Later, he allegedly confessed to taking both the code and presentation materials related to xAI’s methodology for AI model development.
The legal filing further emphasizes that records indicate Li’s actions occurred mere hours after exchanging encrypted communications with Tifa Chen, a recruiter from OpenAI.
Another former engineer, Jimmy Fraiture, is also central to the complaint. The lawsuit suggests that after accepting a position at OpenAI, Fraiture purportedly used AirDrop on numerous occasions to transmit classified documents, including significant portions of the code he managed, along with test projects owned by four co-founding members.
Furthermore, a seasoned finance executive who subsequently joined OpenAI is accused of speaking highly of xAI’s “secret formula” – an apparent reference to the company’s data center team.
Despite a lack of expertise in the field of artificial intelligence, this executive assumed a role at OpenAI focused on the financial aspects of data centers. The suit alleges that when challenged about his obligations to xAI, the executive responded disrespectfully and declined to finalize his separation from the company.
