Importance of the CLARITY Act and Opposition Stances

A key point of contention remains the ethical clause preventing top US officials, including President Trump, from endorsing or participating in crypto initiatives. Although Trump reached a compromise last week, Democrats argue that the stipulations fall short. With Republicans holding 53 seats in the Senate, the bill requires 60 votes, meaning at least seven Democrats must lend their support.

Senator Cynthia Lummis, one of the bill’s sponsors, asserts that the CLARITY Act would address financial loopholes exploited by North Korea’s Lazarus Group. Treasury estimates that Lazarus has appropriated over $3.4 billion in cryptocurrency since 2007. This legislation would equip the Treasury with enhanced sanctioning capabilities and offer exchanges legal protection when they freeze questionable assets.

New York Attorney General Letitia James has voiced her opposition to the bill. She cautions that the CLARITY Act would diminish states’ power to oversee cryptocurrency and address fraudulent activities. Complaints about crypto-related scams to her office have surged threefold over three years, with losses nearly hitting $500 million in that time. James advocates for stronger Anti-Money Laundering (AML) standards and the preservation of state regulatory authority.

Prospects for the CLARITY Act — Future of US Crypto Regulation

Current predictions from Polymarket estimate the chances of the CLARITY Act passing in 2026 at around 33-37%, a notable decrease from over 80% earlier this year. If a vote occurs in September, discussions will coincide with the midterm elections, which typically see lawmakers occupied with various priorities. Even upon Senate approval, the bill must be passed by the House once more before reaching the president.
