A pair of siblings are currently defendants in a US District Court, facing allegations related to a scheme involving automated trading programs operating on a blockchain.

The legal proceedings, which commenced on October 15th in the state of New York, are attracting significant interest from observers within the digital currency community.

Prosecutors in the United States assert that their actions resulted in the misappropriation of approximately $25 million through fraudulent practices. The prosecution claims the brothers deceived other traders in a swift and calculated manner, described by the court as a “bait and switch” scheme.

Conversely, the defense team contends that the true targets of the automated programs were other bots designed for arbitrage, arguing that the brothers’ actions were simply a legitimate trading strategy, not a criminal act.

The defense team also highlighted that the cryptocurrency profits were converted into US currency and taxes were properly paid. According to defense attorney Katherine Trefz, the brothers paid $6 million in taxes prior to their arrests at their residence.

The transactions central to the case transpired in April of 2023; however, the arrests occurred in May of 2024 following a period of technical planning and investigation by the defendants.

Law enforcement officials have charged the men with conspiracy to commit wire fraud, conspiracy to receive stolen goods, and money laundering. Each of these charges carries a potential penalty of up to two decades in prison upon conviction.
