Kroll, a firm specializing in risk management and financial advising, is now the subject of a class-action lawsuit due to its response to a data security incident in August 2023. This incident resulted in the exposure of sensitive data belonging to individuals and entities with claims against FTX, BlockFi, and Genesis.

The legal action, initiated by Hall Attorneys in a U.S. District Court, is being brought on behalf of FTX client Jacob Repko, along with other creditors affected by the breach.

The lawsuit asserts that cybercriminals exploited the compromised data to conduct persistent phishing attacks. Numerous creditors have reported receiving deceptive emails on a near-daily basis.

Sunil Kavuri, an FTX creditor, publicly displayed evidence of persistent phishing attempts, including a series of messages received between August 14th and 17th.

The lawsuit also highlights alleged vulnerabilities in Kroll’s communication strategy with creditors. The firm primarily relied on email, a communication channel that is easily impersonated by fraudsters. The filing suggests this approach eroded trust, complicated the claims process, and, in some instances, resulted in financial losses for creditors.

The plaintiffs are seeking monetary compensation and a restructuring of Kroll’s communication protocols, arguing that creditors should not be limited to a single communication method that can be readily replicated by malicious actors.

Nicholas Hall, leading the Bankruptcy and Complex Litigation division at Hall Attorneys, indicated that affected creditors might be entitled to compensation. He also suggested that the lawsuit could prompt Kroll to improve its operational security measures.

Hall also operates the FTX Claims website, a resource designed to assist creditors in managing their claims.
