Tom Farley, the CEO of Bullish, which owns CoinDesk, remarked that the recent bill’s defeat is not an insurmountable issue.

“Effective legislation would provide the digital asset sector with much-needed clarity. However, even if legislation is passed, the real challenge of enforcement occurs within regulatory bodies, which can expedite the process,” he stated in a post on X. He noted that rulemaking by the SEC and CFTC might have more immediate implications for tokenized securities, particularly regarding the treatment of issuers, transfer agents, and issuer-sponsored tokens.

Nilmini Rubin, the chief policy officer of Hedera, emphasized that the recent vote does not signal the end of the legislative journey. “Policymakers have dedicated significant time and effort to understanding the underlying technology, which is a positive movement toward progress,” she mentioned. “The majority of the industry remains optimistic about achieving our goals.”

However, Rubin warned that the competitiveness of the U.S. is at stake without clear regulatory guidelines.

“The primary casualty is the U.S. competitiveness, as the lack of certainty hinders innovation and adoption domestically compared to other nations,” she explained. “The longer we operate without defined rules, the harder it becomes to keep the United States at the forefront of this sector, rather than relegated to the sidelines.”
