Xai, a gaming network built on the Ethereum blockchain, has initiated legal action against xAI, the artificial intelligence venture headed by Elon Musk. The suit alleges trademark infringement and unfair competition.
The legal document, submitted to the Northern District Court of California on Thursday, asserts that Musk’s company, xAI, has generated significant confusion among consumers, thereby harming the Xai brand.
Ex Populus, the Delaware-based entity that developed Xai, claims to have been actively using the XAI trademark commercially in the United States since June of the previous year. This includes its application within the blockchain gaming sphere and in relation to the $XAI digital currency. According to the lawsuit, “This represents a clear-cut instance of trademark infringement requiring judicial intervention for proper resolution.”
According to the filing, Ex Populus manages the Xai ecosystem. This ecosystem is a blockchain-based network tailored for the video game sector and digital transactions. It offers a foundation supporting game logic, AI-driven processing, incentive structures, and data administration across diverse applications.

xAI’s gaming endeavors exacerbate confusion
The complaint outlines that initial confusion emerged after Musk’s announcement of xAI in July 2023. This confusion intensified following his November 2024 declaration of xAI’s intention to create a gaming division.
The filing states that “significant marketplace confusion erupted, questioning any association, ownership, or sponsorship of Plaintiff’s XAI Trademark or its corresponding products and services by Defendants/Musk.” It included several cases in which individuals, publications and even Musk’s AI assistant Grok inaccurately linked the two companies.
Ex Populus alleges that the impact extends beyond mere loss of brand equity. The lawsuit contends that Xai has had “significant negative consumer sentiment” resulting from Musk’s contentious public image and past controversies related to xAI’s projects.
The legal filing emphasizes, “Plaintiff is suffering irreparable damages due to a loss of control over its diligently developed brand image and associated XAI Trademark, and is further damaged by the confusing association with Elon Musk, leading to considerable adverse consumer attitudes.”

Musk’s legal representatives allegedly pressured Xai regarding trademark ownership
The document accuses Musk’s legal team of attempting to coerce Ex Populus into surrendering trademark rights by threatening to invalidate their registration earlier this month.
The lawsuit also highlights that the United States Patent and Trademark Office (USPTO) has already put a hold on multiple of xAI’s trademark requests because it found a potential for overlap with the existing Xai trademark.
Ex Populus is requesting the cancellation of all pending xAI trademark applications, compensation for damages resulting from the infringement, and a court order that would bar Musk’s company from using the “XAI” brand in the context of gaming and blockchain. “Legal remedies alone cannot adequately address the extensive harm Defendants have caused,” the company stated in its filing.
