Bitcoin has dipped below $78,000 after temporarily exceeding $79,000 overnight, as investors adopt a cautious stance ahead of a crucial vote concerning extensive digital asset legislation in the U.S.

The leading cryptocurrency was valued at approximately $77,960 early on Tuesday, following a peak near $79,580. Bitcoin had gained over 2% on Monday but has since given back some of those gains.

All eyes are on Washington, where the U.S. Senate is set to conduct a procedural vote on the Digital Asset Market Clarity Act at 2:15 PM Eastern Time on Tuesday.

This vote is not the final approval for the legislation. Senators will determine whether to invoke cloture on a motion to advance the bill, which requires 60 votes to move forward for discussion.

Crypto Regulation Under Scrutiny

The Clarity Act aims to create a comprehensive federal regulatory structure for digital assets and to clarify the roles of the Securities and Exchange Commission and the Commodity Futures Trading Commission.

In anticipation of the vote, Republican senators have released an updated version of the legislation, which includes 126 significant amendments requested by Democrats, emphasizing improved ethics and consumer protection measures.

This revised language also seeks to alleviate concerns from banks that cryptocurrency offerings might divert deposits from conventional financial institutions. However, it remains uncertain if these modifications have secured enough Democratic support to achieve the necessary 60-vote threshold.

Former President Donald Trump has endorsed much of a bipartisan ethics proposal addressing crypto interests held by elected officials and their families, which removes a critical barrier to negotiations.

The cryptocurrency sector has invested heavily in advocating for the legislation, contending that clearer guidelines would provide companies with more clarity regarding whether digital assets are classified as securities or commodities.

XRP Rises Ahead of Vote

XRP has notably benefited from the positive sentiment surrounding the legislation.

The token surged nearly 7% on Monday, reaching a high of $1.49 before settling around $1.42 early Tuesday.

Bitcoin had a brief surge above $79,000 overnight, with Ethereum and Solana also seeing gains as traders positioned themselves ahead of the vote. Ether was trading at around $2,530 during early Asian trading, while Solana was priced near $102.

Upcoming Fed Decision

The cryptocurrency markets are facing another significant event soon after the Senate vote.

The U.S. Federal Reserve is expected to announce its latest interest rate decision on Wednesday, leaving Bitcoin in a precarious position between the prospect of meaningful regulatory progress and concerns that tighter monetary policies could impact risk-oriented assets.

Bitcoin has faced challenges in maintaining levels above $80,000, despite peaking at a three-month high of $82,163 earlier in September.

This situation sets the stage for a particularly eventful 48-hour period.

Tuesday will be a test of whether Washington can finally advance comprehensive crypto regulation, while Wednesday will reveal whether monetary policy allows digital assets to capitalize on this potential progress.
